Resolution - WHEREAS, any official position of the City of Los Angeles with respect to legislation, rules, regulations or policies proposed to or pending before a local state or federal governmental body or agency must have first been adopted in the form of a Resolution by the City Council with the concurrence of the Mayor; and WHEREAS, unlicensed and uninsured drivers pose a risk to many people on the roads; and WHEREAS, Californians are unable to purchase auto insurance without a license; and WHEREAS, the issue of allowing undocumented immigrants to have driver's licenses has been considered almost continually since the 1999-2000 Legislative Session; and WHEREAS, the federal Real ID Act of 2005 authorizes states to issue licenses with full driving privileges to drivers who are unable to establish their legal presence in this country, but these licenses cannot not be used for federal identification purposes (e.g., to board an aircraft); and WHEREAS, currently pending in the California legislature is a bill, SB 60 (Cedillo), that would require the California Department of Motor Vehicles (DMV) to issue driver's licenses that are compliant with the federal Real ID Act of 2005; and WHEREAS, SB 60 would require the DMV to issue driver's licenses that permit driving, but are not acceptable for federal ID or for any other official federal purposes ("driving only license"), to those applicants who do not meet the full licensure requirements of the Real ID Act of 2005; and WHEREAS, the "driving only license" will clearly state that it cannot be used by any federal agency for federal identification or any other official purpose and will have a unique design and color feature; and NOW, THEREFORE, BE IT RESOLVED, with the concurrence of the Mayor, that by the adoption of this Resolution, the City of Los Angeles, hereby includes in its 2007-2008 State Legislative Program SUPPORT of SB 60 (Cedillo) that would require the California Department of Motor Vehicles to issue driver's licenses that are compliant with the federal Real ID Act of 2005.
