CONFISCATION / ICE CREAM TRUCKS / SOURCE OF NUISANCE

Motion - The ice cream truck business has changed significantly from 1930 to 1950 to the present time when the absence of adequate home refrigeration made ice cream unavailable to many children. Today most children have easy access to refrigeration in their own homes. As a result, in many neighborhoods ice cream trucks have become the purveyors of illicit goods, poisonous lead bearing candies, illegal replica toy guns and other harmful materials which further degrade the quality of life in working class, family oriented communities. The City has for many years taken actions to regulate and control the illicit and offensive behavior of some ice cream truck vendors. However these actions have for the most part been ineffective in reducing or eliminating the nuisance activities of ice cream trucks, and today we have in many neighborhoods ice cream trucks selling toy guns to minors and possibly disseminating illicit materials. Firm action is needed to address this nuisance situation in the same manner as the City has addressed the problem of street car racing and illegal dumping: confiscation of the offending vehicle. THEREFORE MOVE that the City Attorney be requested to prepare and present an ordinance which would permit the confiscation of any ice cream truck which is engaged in unlawful sale of unpermitted materials such as sale of replica toy guns to minors, or sale of drugs or other illicit materials, or is otherwise found to be the source of nuisance in a community .

REQUEST the Chief Legislative Analyst, with the assistance of the City Attorney, to seek State legislation requiring background checks, including fingerprinting for ice cream truck operators.
