6-28-05 - Council Action - Motion - Padilla / Smith Mover 2005 / Zine / Greuel - ADOPTED - The City of Los Angeles currently uses Sunshine Canyon Landfill in the North San Fernando Valley to dispose of all of its household refuse from the West, West Valley, East Valley, North Central and South Central wastesheds.
The contract with BFI contains several 5-year options for renewal. According to the contract, the City must notify BFI of its intention to continue dumping at Sunshine Canyon, one year prior to the expiration of the existing option period.
It is our duty to examine this and every contract to make sure it is in the best interest of the City of Los Angeles and its residents. It is generally accepted principal that when contracts come up for renewal that they be scrutinized and renegotiated to update and enhance the tenets of the contract for both parties.
THEREFORE MOVE to instruct the City Attorney to renegotiate the following three points in the City's contract with BFI for disposal at Sunshine Canyon Landfill:
1) Remove the requirement for disposal of 100% of the City's Household Refuse in the West, West Valley, East Valley, North Central and South Central waste sheds including any provision which penalizes the City of Los Angeles for falling below a specified tonnage for any length of time, including requirements for replacing aggregate tonnage.
2) Remove any prohibition on the City's ability to negotiate and contract with other vendors for handling the City's household refuse.
3) Remove any language that restricts the City's "most favored nations" status to lower than third-party customers tipping at least 1,000 tons per day under contract for at least one year. The City should receive the lowest price offered to any third-party customer dumping any amount at Sunshine Canyon over any period of time.

8-9-05 - Council Action - Motion - Parks Mover 2005 / Weiss / LaBonge / Rosendahl - ADOPTED *AS AMENDED - Item Number 79 on today's Council Agenda (August 9, 2005) is the contract extension with Browning-Ferris Industries of California, Inc. (BFI), for continued disposal services at the Sunshine Canyon Landfill for an additional five-year term starting on July 1, 2006 through June 30, 2011. Last Friday, the Council debated this issue and, since there were insufficient votes to approve or reject the matter, the item is before the Council today pursuant to Council Rule 53.
BFI had originally extended the time frame for the City to act on the contract option until August 5,2005. Subsequent to the Council debate last Friday, BFI sent a new letter to the City, extending the option date to August 19, 2005. At the request of the Mayor in a letter dated August 8, 2005, BFI has agreed to further extend the option date until February 28, 2006.
The debate in Council revealed many disposal options that may be available to the City instead of the use of landfills. Because BFI has agreed to extending the option date, it affords the City the opportunity to review and assess the feasibility and viability of trash disposal alternatives. In addition, the Department of Public Works, Bureau of Sanitation has indicated they will be releasing a report on alternative technologies within the next few weeks which may provide further alternatives.
THEREFORE MOVE THAT the City Council continue Item Number 79 on today's Council Agenda (August 9, 2005) relative to the extension of the BFI contract for disposal services at Sunshine Canyon Landfill until the City Council meeting of February 10, 2006.
FURTHER MOVE THAT the City Council request the Department of Public Works, Bureau of Sanitation, to review the options presented in Council to determine the feasibility, time frame and costs for implementation, including the use of day-to-day trash disposal using the "spot market;" increasing the recycling rate from "black to blue" bins; rail haul of City-collected refuse; issuing a new request-for-proposal for trash disposal; alternative technologies such as thermo-recycling and waste to energy options; and any other viable options that may develop.
FURTHER MOVE THAT the City Council request the Department of Public Works, Bureau of Sanitation, to provide a status report to the City Council every *two weeks (Greuel - Parks).*
8-9-05 - Council Action - Amending Motion - LaBonge Mover 2005 / Parks - ADOPTED - MOVE that the matter which is the subject of Item No. 79 on today's Council Agenda (CF 05-1179), BE AMENDED to resolve that the Council shall conduct a special meeting in January of each year devoted exclusively to discussion of solid waste management services and costs - said meeting to be well in advance of the City's annual budget process, before the Mayor releases his budget, and to permit sufficient time for the Council to have input on options, policy, etc. before the budget is finalized.
8-9-05 - Council Action - Motion - Smith Mover 2005 / Rosendahl / Hahn - ADOPTED - It has come to the attention of Council that reasonable and viable bids were submitted and subsequently excluded from the City's second RFP for Landfilling solutions outside of the City of Los Angeles (REP II).
It appears as though the Bureau of Sanitation (BOS) crafted an RFP that was so narrow that only two companies could have qualified under the provisions: Waste Management and BFI. There have also been accusations that BOS staff further narrowed the scope of the RFP during the evaluation process.
Doing so could have prevented the Council from being exposed to many viable alternatives for dealing with the City's waste. Subsequently, we are faced with less than a year to identify and evaluate the validity of various options.
Inasmuch as the Council has previously acted to simultaneously issue an RFP while negotiating with a current vendor for a more equitable or appropriate option.
THEREFORE MOVE that the Board of Public Works report immediately to the Ad Hoc RENEW LA Committee regarding the issuance of and language for an immediate RFP for short term municipal solid waste solutions that do not require the use of the Sunshine Canyon Landfill.
FURTHER MOVE that the RFP exclude any language requiring the applicant to own landfills and be broad enough to include all viable possibilities, including those that would allow vendors to bid for individual or multiple wastesheds as well as the totality of the City's trash.
FURTHER MOVE that the Board of Public Works immediately issue an RFQ for P.R./Educational programs that can assist the City in increasing recycling and diversion in the single-family, multi-family and commercial sectors and that the Bureau of Sanitation report immediately to the Ad Hoc RENEW LA Committee detailing existing P.R./Educational programs and plans to increase recycling and diversion.

2-24-06 - Council Action - Motion - Garcetti Mover 2006 / Smith / Greuel / Cardenas / Parks - ADOPTED *AS AMENDED - MOVE that Item 18 on today's Council Agenda relative to the Budget and Finance and Environmental Quality and Waste Management Committees' Reports on Amendment No. 2 to the contract with Browning-Ferris Industries of California, Inc. (BFI), for continued disposal services at BFI Sunshine Canyon Landfill for an additional five-year term starting July 1, 2006 and ending June 30, 2011 be amended to authorize the President of the Board of Public Works, subject to the approval of the City Attorney as to form and legality, to exercise the City's option and execute said extension to City Contract No. C-93688, provided that the amendment contain the following provisions:
* Permit the City, at its sole discretion and without penalty, to divert one waste shed or the equivalent thereof that is consistent with the City's adopted policy (CF 05-1364) of reducing the first year tonnage by 600 tons per day of the CITY CAPACITY (defined in the contract as the household refuse collected in the Western, West Valley, East Valley, North Central and South Los Angeles Refuse Collection Districts).
* Permit the City to reduce the CITY CAPACITY, without penalty, if it is attributable to the City's use of facilities which transform, convert, recycle or reuse the waste
through the use of any alternative technologies.
* A "favored nations" clause which will ensure that the City is entitled to receive the lowest price charged by BFI to any third part customer with similar waste streams.
FURTHER MOVE that BFI make every reasonable effort to address and minimize the truck turnaround time at Sunshine Canyon, consistent with Section 4.1.5 of the current agreement which specifies a 25-minute period.
FURTHER MOVE that the Bureau of Sanitation report back to the City Council on an implementation plan to achieve the reduction in tonnage over the subsequent four years, consistent with the City's adopted policy (CF 05-1364), with particular emphasis on initiatives that reduce trash volume that is currently landfilled.
FURTHER MOVE that the Bureau of Sanitation seek out BFI and other any other waste disposal companies to develop partnerships to pursue any and all initiatives that are alternatives to the use of landfills.

2. INSTRUCT the Bureau of Sanitation, working with the City Attorney, to bring forward a policy recommendation for the Council to adopt, that the City, working within the confines of the BFI contract, desires to divert from landfills as much solid waste as possible, to be used for alternative uses, i.e., green power, recycling, and reuse.
3. REQUEST the City Attorney to report back to the Budget and Finance Committee relative to recommendations on legal options the City may pursue during the five-year BFI contract extension and while abiding by the BFI contract, that will enable the City to develop more recyclables and to achieve greater diversion of solid waste from landfills to alternative uses.
4. INSTRUCT the Bureau of Sanitation to report back to the Budget and Finance Committee every six months relative to the status of the development of options to divert more solid waste from landfills, goals for achieving greater diversion, new Request for Proposals, etc.
