9-12-07 - Council Action - Verbal Motion - Hahn Mover 2007 / LaBonge - ADOPTED, HEREBY MOVE that Council ADOPT the following recommendations with respect to request for Determination of "Public Convenience or Necessity" Application for the sale of alcoholic beverages, for off-site consumption at Fresh & Easy Neighborhood Market located at 26640 Western Avenue in Council District 15 on today's Council agenda (Item No. 16, CF 07-2552), pursuant to AB 2897 (Caldera) and required Findings by the State Department of Alcoholic Beverage Control under Business and Professions Code Sections 23958 and 23958.4:
Recommendations for Council action:
1. DETERMINE that the issuance of a liquor license at Fresh & Easy Neighborhood Market located at 26640 Western Avenue will serve the "Public Convenience or Necessity" and will not tend to create a law enforcement problem.
2. GRANT the Application for Determination of "Public Convenience or Necessity" for the sale of alcoholic beverages for off-site consumption at 26640 Western Avenue.
3. INSTRUCT the City Clerk to transmit this determination to the State Department of Alcoholic Beverage Control as the required findings under Business and Professions Code Section 23958.4.
