Special Mo 1 - Ccl will be in recess from 12-21-88 thru 1-2-89 &
there is an immediate need for consultation with its legal counsel,
Atty, to receive advice in consideration of litigation matters that
arose subsequent to posting of Ccl agenda. NOW THEREFORE, pursuant to
authority in Government Code Sec 54954.2(b)(2) - 549542b2, MOVE that
Ccl, by adoption of this Mo by at least 10 votes, determines that
need to take action arose subsequent to posting of today's Ccl
agenda; & FURTHER MOVE, upon such determination, as auth by
Government Code Sec 54956.9((a) - 549569a, Ccl hold a closed session
to confer with its legal counsel, Atty, with respect to certain
ongoing litigation
Mo - Ferraro - Bernson 1988 - MOVE, pursuant to advice received in
Closed Session conferred with Atty, & recs of said office, that, subj
to approval of Mayor, $255,000 (255000) be transferred from Reserve
Fd to Unapprop Bal & approp therefrom to City Atty Liability Claims
Acct 9770, & that Atty be auth to expend all or part of said sum as
rec for litigation expenses & to provide Court with a copy of Ccl's
action in matter reviewed, including its findings with respect
thereto
