Washington Irving Middle School / Proposition K Project

Motion - WHEREAS, The Los Angeles Unified School District - Washington Irving Middle School project was included in the Resolution of Intention, as a part of bond funding under the Proposition K - L.A. for Kids Program, approved by the Los Angeles City Council on November 19, 1999 and a Resolution of Sale of Bonds, approved by the City Council on December 7, 1999. WHEREAS, The project was awarded $1,374,700, less a Capital Matching Fund amount which was estimated to range from $302,210 to $368,795, depending on the interest rates at the times the bonds to fund the Proposition K funded portion of the project were sold. WHEREAS, On March 15, 2000, the bonds were sold by the City, and the Los Angeles Unified School District, Washington Irving Middle School (Grantee) was awarded the above described funding towards the design and construction of improvements to an existing school recreation facility, to include: design and construction of a sportsfield on the school playground area, a picnic and rest area, tree planting; installation of outdoor lighting; and construction of an ADA-accessible restroom. (C-99587, attested by the City Clerk on March 2, 2000) WHEREAS, On March 22, 2002, the Proposition K - L.A. for Kids Steering Committee reviewed and recommended approval of a request for an extension of time to November 15, 2002, to accommodate various delays to the project, including the need to conduct numerous community meetings through August 2001 and delays in obtaining Division of the State Architect approval of the construction plans. THEREFORE MOVE that: The City Engineer be directed to amend the subject AGREEMENT (Contract No. C-99587, executed on March 2, 2000, Council Files 00-0531 and 97-0031-S11), to provide for approval to extend the contract term, including all closeout activities, until November 15, 2002. 6-24-03 - This days Council session - Motion - Garcetti Mover 2003 / Pacheco - The City Council previously awarded a Proposition K competitive grant to the Los Angeles Unified School District (LAUSD) - Washington Irving Middle School, in the amount of $1,374,700 (less a required Bond Match of $269,712), for improvements to an existing school recreation facility, to include: design and construction of a sportsfield and running track; a passive picnic and rest area, including tree planting; installation of outdoor lighting; and construction of an ADA-accessible restroom adjacent to the passive picnic and rest are (See C-99587).
On April 28, 2003, the Los Angeles Unified School District request that the scope of the project be revised to allow a proposed passive park to be changed to an active park, to allow use for school recreational activities and Physical Education classes during the school day, and community use, including organized soccer activities, during the joint-use hours. According to the Bureau of Engineering, although the project was substantially complete by November 15, 2002, the passive park area was not completed, due in part to the possibility that the area would be needed as a temporary school site. A request to house a temporary school site was later withdrawn by the Los Angeles Unified School District.
Since then, the City and Los Angeles Unified School District have been working together to determine the appropriate use of the passive park area. It should be noted that the nearby Juntos Park was recently completed. Juntos Park is a passive park within two blocks of Washington Irving Middle School, and will provide adequate passive park amenities for the local neighborhood surrounding the school.
On May 15, 2003, the L.A. for Kids Steering Committee, in consultation with City Attorney, considered Los Angeles Unified School District's request to revise and amend the Proposition K Grant Agreement to reflect the Los Angeles Unified School District's proposed changes. The Steering Committee found that the proposed change from passive park to active park constituted an immaterial change, as the passive park portion of the project originally proposed is the smaller, and much less significant portion, of the overall project. Therefore, converting its use from "passive park" to "active park" is an immaterial change to the overall project. The Steering Committee also authorized a time extension through July 31, 2003, and reduced the grant award by $10,575 to account for the cost reduction. The Steering Committee's recommendations are now subject to the City Council's approval. Additionally, the grant should be extended through September 30, 2003 (rather than July 31, 2003), to allow sufficient time for all close out activities.
THEREFORE MOVE that the City Council take the following actions relative to a Proposition K Grant Agreement (C-99587) with the Los Angeles Unified School District-Washington Irving Middle School:
1. Find that based on the facts, the proposed change from "passive park" to "active park" space is immaterial to the overall project;
2. Authorize the City Engineer to negotiate and execute an amendment, or related document, which changes the passive park area noted in the Proposition K Grant Agreement (C-99587) with the Los Angeles Unified School District-Washington Irving Middle School to an active park, to extend the term of the design and construction, including all closeout activities to September 30, 2003, and any other such changes which are necessary to effectuate these actions, subject to the approval of the City Attorney;
3. Require the Los Angeles Unified School District-Washington Irving Middle School provide the City with the detailed design plans for the active park and for the improvements to fences and gates;
4. Require the Los Angeles Unified School District-Washington Irving Middle School provide written monthly progress reports to the L.A. for Kids Steering Committee, including reports on the causes and remedies of any future potential delays;
5. Affirm that no future extensions to the project will be granted; and
