9-17-03 - Verbal Motion - Cardenas Mover 2003 / Smith - ADOPTED IN OPEN SESSION - HEREBY MOVE that Council ADOPT the following recommendations of the City Attorney in order to effect settlement in the case entitled Regency Outdoor Advertising, Inc. and Virtual Media Group, Inc. v. City of Los Angeles, United States District Court Case No. CV 00-9913 FMC. (This case involves a constitutional challenge to the mural sign provisions of the City?s Sign Ordinance.), SUBJECT TO THE APPROVAL OF THE MAYOR:
1. AUTHORIZE the City Attorney to expend $187,219.15 in settlement of the case entitled Regency Outdoor Advertising, Inc. and Virtual Media Group, Inc. v. City of Los Angeles, United States District Court Case No. CV 00-9913 FMC, from the Liability Claims Account 9770, Fund 100, Department 59, in satisfaction of Regency?s Motion for attorney fees and costs.
2. AUTHORIZE the City Attorney to draw a demand thereon in said amount payable to Regency Outdoor Advertising, Inc. and Spach & Associates Trust Account - (Budget and Finance Committee waived consideration of the above matter).
9-17-03 - MEMORANDUM TO FILE - The City Council held a Closed Session on Wednesday, September 17, 2003 pursuant to authority provided in California Government Code Section 54956.9(a) and/or (b) to confer with its legal counsel relative to settlement in case entitled Regency Outdoor Advertising, Inc. and Virtual Media Group, Inc. v. City of Los Angeles, United States District Court Case No. CV 00-9913 FMC (This case involved a constitutional challenge to the mural sign provisions of the City?s Sign ordinance; Budget and Finance Committee waived consideration of the above matter).
The purpose of this memorandum is to note for the record that following discussion of the above matter in Closed Session, the City Council adopted the Motion (Cardenas - Smith) in Open Session and instructed the City Clerk to transmit the file to the Mayor forthwith.
