CHARTER SECTION 912 / COMMISSION TO EVALUATE NEIGHBORHOOD COUNCIL SYSTEM

Motion - It has been five years since the enactment of the new Los Angeles City Charter and the institution of our system of neighborhood councils. During that time, we have made great strides in a very difficult and challenging task of implementing a system of neighborhood councils for the second largest city in the Nation. To date, we have been successful in instituting 86 neighborhood councils. Section 912 of the Charter requires the Mayor and Council to appoint a commission as prescribed by ordinance to evaluate the provisions of the Charter relative to neighborhood councils, the Regulations adopted for neighborhood councils, and the efficacy of the system of neighborhood councils no later than seven years after the adoption of the Charter. Such a commission shall make recommendations to the Council regarding changes to the Charter or the Regulations, as it deems appropriate. Now is the appropriate time to begin the process for complying with the Charter requirement to evaluate our neighborhood council system. THEREFORE MOVE that the Chief Legislative Analyst, working in conjunction with the Department of Neighborhood Empowerment and the assistance of the City Attorney, to report with recommendations for appointing a commission to evaluate our system of neighborhood councils as required by Section 912.

4-21-06 - Council Action - *Amending Motion - Hahn Mover 2006 / Cardenas - ADOPTED - MOVE that the Education and Neighborhoods Committee Majority Report relative to the appointment process for the Neighborhood Council Review Commission, #36 on today's City Council agenda (CF 05-0894) BE AMENDED to adopt the following appointment and confirmation process in lieu of what is contained in the Majority Report:
* Each City Councilmember shall be allotted one (1) nomination to the Neighborhood Council Review Commission. These nominations shall be subject to Council confirmation.
* The Mayor shall be allotted a total of ten (10) nominations to the Neighborhood Council Review Commission, seven (7) of which will be based on recommendations from the Neighborhood Councils. These 10 nominations shall be subject to Council confirmation.
Recommendations from the Neighborhood Councils:
a. Nominee shall be selected by Neighborhood Councils residing in each of the Area Planning Commission boundary areas, for a total or seven (7) recommendations by the Neighborhood Councils. If for any reason, the Neighborhood Councils in a given Area Planning Commission area cannot agree on a nominee, each neighborhood council shall submit their own recommendation, which will be submitted into that Area Planning Commission area's pool of nominees, from which one (1) shall be selected by the Mayor.
b. Neighborhood Councils shall select their representatives to the Commission at the Congress of Neighborhoods on June 17, 2006. The Department of Neighborhood Empowerment will ensure that this matter is placed on the agenda for this Congress and provide all necessary accommodations.
4-21-06 - Council Action - *Verbal Amending Motion - Padilla Mover 2006 / Hahn - ADOPTED - HEREBY MOVE that Council AMEND the Amending Motion (Hahn - Cardenas) in connection with the appointment process for the Neighborhood Council Review Commission (Item No. 36, CF 05-0894), as follows:
1. The Mayor shall be allotted a total of 14 nominations to the Neighborhood Council Review Commission. These seven nominations shall be subject to Council confirmation. The next seven will be based on recommendations from the Neighborhood Councils, as described below.
2. Recommendations from the Neighborhood Councils:
a. Two nominees shall be selected by Neighborhood Councils residing in each of the Area Planning Commission boundary areas, for a total of 14 recommendations. *Neighborhood Councils have the option to rank their nominees. *(Greuel - Padilla). The Mayor shall select seven from this pool of nominees.
b. Neighborhood Councils may select their representatives to the Commission at the Congress of Neighborhoods on June 17, 2006. The Department of Neighborhood Empowerment will ensure that this matter is placed on the agenda for this Congress and provide all necessary accommodations.
3. Establish the quorum for the 29 member commission at 15. *(Cardenas - Parks).
