9-6-73 - Public Works Committee report ADOPTED to:
1. That Ccl does hereby adopt a policy of permitting BPW to renounce any claim to areas dedicated by tract map as future streets & alleys over 25 years ago, sold to a third party and not used or dedicated for public st or alley purposes, as the prerogative to accept the offer of dedication no longer exists and the public interest in the area has expired.
2. That City Eng be instructed to make a complete investigation of all requests for future street, alley and walk vacations, quiet title actions or relinquishments initiated by either a private or public entity, in order to determine if the provision of Section 748.5 of the Code of Civil Procedures applies.
3. That if the Board determines that Section 748.5 - 7485 - of Code of Civil Procedure is applicable, said Bd be permitted to authorize the President or two members of said Bd to execute and City Clerk to attest a document titled "Relinquishment of Rights & Acknowledgement of Terms to Offer Dedication", substantially in the form attached to file, that will relinquish any and all rights of City thereto, following approval of said document by Atty.
4. That said Bd cause Bureau of Right of Way and Land to record said relinquishment document after required fees be paid.
5. That, except for requests initiated by Ccl controlled public agencies, sufficient fees be paid to Bureau of Right of Way & Land to defray right of way expenses.
6. That at such time as BPW formally relinquishes the City's rights to future sts, alleys or public ways, the official file thereon, together with a recorded copy of the relinquishment, be forwarded to City Clerk for placing in the Archives without further Ccl action.
