Resol - NOW THEREFORE BE IT RESOLVED that the City Council of the City of Los Angeles finds that a local emergency currently exists in the City of Los Angeles in connection with the AIDS epidemic and the transmission of HIV through contaminated injection drug equipment. BE IT FURTHER RESOLVED that the City Council of the City of Los Angeles hereby requests and urges the Mayor of the City of Los Angeles to declare such a local emergency to exist, pursuant to Section 8.27 of LAAC, and to utilize local emergency powers to direct the City AIDS Coordinator and all appropriate City departments, agencies, and personnel to immediately take all steps permitted by law to allow for the availability and uninterrupted operation of needle exchange programs in the City of Los Angeles or for the residents of the City of Los Angeles, *investigation, detention, seizure, forfeiture, arrest or prosecution arising out of alleged violations of state drug paraphernalia laws in connection with a needle exchange program operating in the City of Los Angeles or for the City's residents, due to the overriding needs of public health, safety and welfare during this time of local emergency

9-6-94 - Mayor's Message - DECLARATION OF LOCAL EMERGENCY - By virtue
of the authority vested in me as Mayor of the City of Los Angeles,
pursuant to provisions of LAAC Section 8.27, I hereby find that: An
emergency in connection with the AIDS epidemic and the transmission
of HIV through contaminated needles exists; Said emergency threatens
to cause extraordinary loss of life. NOW THEREFORE I hereby declare
the existance of a Local Emergency and I do hereby direct the City
AIDS Coordinator and all appropriate City departments, agencies, and
personnel to immediately take all steps permitted by law to allow the
availability and operation of responsible needle exchange programs in
the City of Los Angeles which are conducted by non-profit or social
service agencies in stable, secure locations developed in
consultation with residents of the community business owners, other
social service agencies and the potential client of the service and
whose efforts are directed solely toward preventing the speard of
AIDS or HIV.
FURTHER encourage the City Atty, Police Department and Police
Commission to immediately create and implement proper procedures to
avoid needless investigation, detention, seizure, forfeiture, arrest,
or prosecution arising out of alleged violations of state drug
paraphernalia laws based upon participation in a needle exchange
program operating in the City of Los Angeles. I hereby ask those law
enforcement and prosecutorial agencies, authorities, and personnel
with jurisdiction over such matters to formulate policy and direct
resources in a manner consistent with this Declaration pursuant to
aforementioned needle exchange programs due to the overriding needs
of public health, safety and welfare during this time.
FURTHER direct the City AIDS coordinator to work with City
departments to (1) insure that all nonprofit or social service
agencies who participate in needle exchange programs do so consistent
with the terms of this declaration (2) and provide HIV prevention and
drug abuse education / referral information

29, December 13, 21, 1994; Jan 4, 18, & Feb 1, 1995 the Ccl of the City of LA
ratified the Mayor's declaration dated 9-6-94 wherein he declared that, due to
the AIDS epidemic & the transmission of HIV thru contaminated needles within
the City of Los Angeles, a local emergency existed.
By reason of its magnitude, this emergency threatens to cause extraordinary
loss of life.
The emergency threat to life continues to exist within City of LA, & that
emergency measures are necessary to mitigate the possibility of further HIV
transmission.
In accordance with CAO, Section 8.27the governing body of the City of LA must
review the resol approving Declaration of a Local Emergency at least every 14
days after the initial approval.
The City of Los Angeles is continuing to carry out required emergency
abatement.
