11-22-02 - This day's Council session - Communication recommendations from Environmental Quality and Waste Management Committee, subject to the approval of the Mayor to:
1. FIND that the "Leaves of Learning" project is categorically exempt from the California Environmental Quality Act (CEQA) of 1970, pursuant to Article VII, Class 1(3) and Class 4(3) of the City's Environmental Guidelines, as the project will make only minor alterations to sidewalks for tree planting.
2. ADOPT the accompanying RESOLUTION that authorizes the General Manager, Environmental Affairs Department, to apply, on behalf of the City, for $250,000 in State Environmental Enhancement and Mitigation Program funds for the "Leaves of Learning" tree-planting project.
3. FIND, in accordance with Charter Section 1022, that the work to be performed during implementation of this project can be performed more feasibly by independent contractors, rather than by City employees, in view that the work is of limited scope and short-term duration.
4. AUTHORIZE the Controller to appropriate $60,000 from the Environmental Affairs Department Trust Fund (No. 537) receipts to Account No. 0038 for use as front-funding for the Tree-lined Routes to the River grant project.
5. AUTHORIZE the transfer of funds in accounts within the Environmental Affairs Department, as detailed in Attachment 1 to this Communication, to allow implementation of the Environmental Affairs Department?s grant-funded tree-planting projects.
6. EXEMPT from the Fiscal Year 2002-2003, hiring freeze one position of Environmental Specialist I (Employment Authority), Code 7310-1, as the position is critical to the timely delivery of the grant-funded projects and as the position is special funded.
7. REQUEST the Board of Public Works to instruct the Bureau of Engineering to waive concrete cut permitting fees for tree-well sidewalk cuts requiring "A" Permits, as necessary to implement tree-planting projects of the Environmental Affairs Department - (Personnel and Budget and Finance Committees waived consideration of the above matter).

2. DETERMINE, in accordance with City Charter Section 1022, that the work to be performed for the Rooted in Neighborhoods Project, can be performed more feasibly by independent contractors than by City employees, as it is of a limited scope and duration.
3. AUTHORIZE the Controller to establish a new account entitled Rooted in Neighborhoods Account No. 0040 within the Environmental Affairs Trust Fund No. 537.
4. AUTHORIZE the Controller to implement the necessary transactions to TRANSFER and APPROPRIATE funds as follows:
a. $40,000 from the Available Balance in the Environmental Affairs Trust Fund No. 537 to the Rooted in Neighborhoods Account No. 0040 to use as front-funding for the Rooted in Neighborhoods grant project.
b. $60,000 from the Available Balance in the Environmental Affairs Trust Fund No. 537 to the Los Angeles Green Corridors Account No. 0037 to use as front-funding for the Los Angeles Green Corridors grant project.
c. $83,095 from the Environmental Affairs Trust Fund No. 537, Los Angeles Green Corridors Account No. 0037 to the EAD Fund 100/37, As-Needed Salaries Account No. 1070 to pay City staff working on the Los Angeles Green Corridors grant project.
d. $10,000 from the Environmental Affairs Trust Fund No. 537, Greenways to Schools Account No. 0039 to the EAD Fund 100/37, As-Needed Salaries Account No. 1070 to pay City staff working on the Greenways to Schools grant project. FIND, in accordance with the City of Los Angeles Charter Section 1022, that the work to be performed during the Growing Livable Neighborhoods tree planting project implementation can be performed more feasibly by independent contractors rather than by City of Los Angeles employees, in view that the work is of a limited scope and short-term in duration.
4. TRANSFER $14,269.03 from Fund No. 537, Account No. 0039 (GreenWays to Schools), to As-Needed Salaries, Account No. 1070; and $2,150.47 from Fund No. 537, Account No. 0037 (LA Green Corridors) to As Needed Salaries, Account No. 1070 for Fiscal Year 2004-05.
5. INSTRUCT the Bureau of Contract Administration to provide no-fee inspections for trees planted through the EAD’s tree planting grant funded project, LA Green Corridors project.
6. AUTHORIZE the General Manager, EAD, or designee, to release a Request for Qualifications for the Rooted in Neighborhoods project and to execute agreements to implement the project, subject to City Attorney review as to form.
7. EXEMPT from the hiring freeze through June 30, 2005 the following as-needed positions, which will be fully funded by grant monies:
