2-28-96 - PS Comt rept ADOPTED *AS AMENDED TO REQ City Atty with assistance of
OPG Steering Comt, TO PREPARE & PRESENT the following documents to provide for
competitive bidding procedures for OPG franchise type contracts & to fully
recover City costs associated with its towing prog:
A. An Ord adding Section 80.77.3 to LAMC establishing contracting procedures
for OPG to state that contracts for existing OPG areas be awarded at the rate
of at least 4 per year beginning in Calendar Year 1996 based on seniority until
completed.
B. Proposed RFP to reflect these changes or clarification:
1. City cost recovery fees apply only after the total lien is satisfied.
2. Contracts be issued in the ownership interest or corporate name of the OPG &
give the authority to sell such ownership interest or stock.
3. Any sale of a majority of the stock or ownership interest will specifically
require approval of the purchaser by Ccl after rec by Police Comsn.
4. An annual CPI adjustment based on LA County Transportation Index shall be
applied to all OPG fees, effective January 1, of each year.
5. Each awarded 5-year franchise contain an option to renew for a second 5-year
period upon approval by Ccl.
6. Up to, but no more than, two (2) franchises be awarded to one operator.
7. Ccl approval shall be required for:

9. Stipulate that a contractor's primary OPG facility be located within City of
LA & that contractors not own, or have a controlling interest in the operation
of, any auto dismantling or wrecking yards, auto body shop, repair shop, used
car lot, or any other auto-related business.
*10. Past performance of a previous or current OPG contractor shall be included
among the criteria for awarding any new OPG franchise. *(Goldberg-Wachs)
C. An Ord to establish a Gross Receipts Fee equal to *seven percent *(7%) of
all revenues obtained by the franchise through its OPG status - including the
towing, parking, & the sale of lien vehicles - such fees to be paid by all
OPG's, effective immediately, to the City Clerk on a quarterly basis
substantially in conformance with the provision of the proposed RFP.

D. An Ord to revise the LAMC to require that impounded vehicles valued over
$250 that are abandoned or not claimed by their owners be assessed a Vehicle
Release Fee (existing) after the total lien costs have been satisfied in
accordance with the provisions of the proposed RFP.

Section 80.77.4 to the Los Angeles Municipal Code to establish contracting
procedures for official Police Garages. Ordinance provisions include
authorization for the Board of Police Commissioners, subject to Ccl approval,
to award OPG contracts for a fixed 5-year term for each geographic police area
of the City utilizing the City's standardized bid and contract procedures, and
evaluations of past performance of any proposer which has in the past operated
as an OPG. Initial contracts shall be over a 4-year period commencing in 1996,
with a goal of issuing at least four contracts per year and contract procedures
implemented successively based on the OPG's seniority within the designated
geographic area. Ccl approval is required for renewal of contracts for an
additional 5-year period and transfer of ownership of an OPG contract. OPG's
shall pay a 7% gross receipts fee on a quarterly basis from revenue generated
from towing, storage & sales of lien vehicles

1. REQUEST the City Atty to draft an ordinance amending the LAMC to extend the time from 90 to 180 days allowed to new official police garages to obtain proper permits, equipment, personnel and property after being awarded an Official Police Garage (OPG) designation
*2. DIRECT the Los Angeles Board of Police Commissioners to report back in two weeks with recommendations on both policy and procedural changes to the Boards Rules Governing Official Police Garages to insure that any single Ccl District is not overly burdened with an excessive number of OPG storage yards (Hernandez - Chick)
*3. DIRECT the Department of General Services to work with ATS Tow and Ccl District 1 to identify an alternative OPG vehicle storage location to the site at 2010 North Figueroa, including but not limited to exchanging that location for available, unused City owned property (Hernandez - Chick)
